1. The international community as the environment for the operation of international law
2. The concept of international law, including its specific nature, functions and structure; international law and international relations
3. Subjects of international law: states, international organisations, atypical subjects (e.g. the Holy See, the Order of Malta), non-state actors. Forms of action by states and other subjects in international relations, including diplomatic and consular law
4. Principles (sovereignty, equality, non-interference in internal affairs) and institutions protecting states (including state immunity). Elements of a state: population (issues of citizenship, foreigners, stateless persons), territory (essence, components – land, sea and air, acquisition, loss, territorial sovereignty, limitions on the use of territory), state authority (recognition of government). Learning outcomes
The student knows and understands: SPM1_W01: advanced methods of interpreting international law; SPM1_W02: advanced general and specific (selected) issues in constitutional and international law relating to subjects of international law: states and international organisations; SPM1_W03: the legal conditions governing the professional activities of diplomats, consuls, foreign service employees, international organisations, international corporations, or the legal conditions governing entrepreneurs who plan or carry out foreign expansion, in terms of the legal aspects of international relations; the student is able to: SPM1_U01: interpret the legal relations between entities of international relations, express themselves in legal language on these relations and justify their position from a legal point of view; SPM1_U02: use their legal knowledge in the field of international law; formulate and solve legal problems and perform tasks typical of the professional activities of a diplomat, consul, foreign service employee, international organisation, transnational corporation, or entrepreneur conducting foreign expansion, based on their legal knowledge; formulate and solve complex and unusual problems and perform tasks in conditions that are not fully predictable by selecting appropriate sources and methods of interpreting international law, including advanced information and communication technologies; Graduates are prepared to: SPM1_K01: cultivate and promote models of appropriate conduct in the legal work environment and beyond; make independent decisions, critically evaluate their own actions, the actions of the teams they lead, and the organisations in which they participate, and take responsibility for the consequences of these actions; SPM1_K02: critically evaluate their legal knowledge in the field of international law, including its specific branches; recognise the importance of knowledge in solving legal problems in the field of international relations and seek the opinion of legal experts in case of difficulties in solving a legal problem independently.
Assessment criteria
The prerequisite for taking the examination is passing both semesters and passing the winter semester lectures on the basis of an essay on a given topic.
Oral examination based on lectures and classes (they are complementary to each other to a certain extent, the material covered in lectures and classes is not fully overlapped); three basic questions of a more general nature, with the possibility of elaborating on them during the examination.
