Administrative court proceedings WP-PR-PSA
Course Objectives and Goals: The objective of the course is to present the general issues of administrative court proceedings in order to prepare students for the practical application of administrative law in administrative courts. The course aims to enable students to understand the procedures appropriate for supervising the actions of public administration and to apply the provisions of the Administrative Court Procedure Act (Prawo o postępowaniu przed sądami administracyjnymi).

1. The Nature and Organization of Administrative Courts - 1.5 hours
2. The Scope of Administrative Court Jurisdiction, Jurisdiction of Provincial Courts and the Supreme Administrative Court - 2 hours
3. The Subject Matter of Administrative Court Proceedings, the Concept of an Administrative Court Case - 1 hour
4. Parties and Participants in Administrative Court Proceedings - 1.5 hours
5. Documents in Administrative Court Proceedings - 1 hour
6. Conditions for the Admissibility of Administrative Court Proceedings - 2 hours
7. The Course of Proceedings Before the Provincial Administrative Court in the Regular Procedure - 2.5 hours
8. Special Proceedings - 2 hours
9. Obstacles to Administrative Court Proceedings - 2 hours
10. Decisions Made in Administrative Court Proceedings at First Instance - 4 hours

PR_W01: Demonstrates knowledge of the nature and organization of administrative courts
PR_W02: Knows and understands the scope of jurisdiction of administrative courts and the subject matter of administrative court proceedings
PR_W04: Discusses legal regulations regarding administrative court proceedings (concerning the subjects of proceedings, documents, course of proceedings, decisions, etc.); characterizes the conditions for the admissibility of a complaint to an administrative court
PR_W05: Knows legal regulations regarding ordinary and extraordinary remedies in administrative court proceedings.
Assessment criteria
Methods of verifying learning outcomes:
PR_W01; PR_W02; PR_W04; PR_W05: written exam (3-4 open-ended questions, test + 1-2 open-ended questions in the make-up session), oral exam - in the zero session and for dyslexics, dysgraphics, and in the event of special circumstances preventing written knowledge testing, and in remote learning.
Assessment criteria:
For a grade of "fail" (2) student:
- lacks knowledge of the nature and organization of administrative courts (cannot describe the model of administrative courts in Poland or indicate legal regulations in this area)
- does not know or understand the scope of jurisdiction of administrative courts and the subject matter of administrative court proceedings
- is unable to discuss legal regulations in the field of administrative court proceedings (concerning the subjects of the proceedings, documents, course of proceedings, decisions, etc.); is unable to characterize the conditions for the admissibility of a complaint to an administrative court
- is unfamiliar with legal regulations regarding ordinary and extraordinary remedies in administrative court proceedings
For a grade of “passable” (3) student:
- has sufficient knowledge of the nature and organization of administrative courts (can identify the types of administrative courts, the constitutional basis for their operation, and statutory acts concerning administrative courts)
- generally correctly describes the scope of jurisdiction of administrative courts and the subject matter of administrative court proceedings as specified in the regulations
- can present basic legal regulations in the field of administrative court proceedings (concerning the subjects of the proceedings, documents, the course of the proceedings, decisions, etc.); correctly lists the conditions for the admissibility of a complaint to an administrative court and characterizes some of them
- knows the legal regulations regarding ordinary appeals in administrative court proceedings and certain extraordinary remedies
For a grade of 'good' (4) student:
- has sound knowledge of the nature and organization of administrative courts (can identify the types of administrative courts, the constitutional basis for their operation, statutory acts concerning administrative courts, as well as court bodies, requirements for the position of judge, etc.)
- correctly describes the scope of jurisdiction of administrative courts and the subject matter of administrative court proceedings, as defined by the regulations, and is able to provide specific examples of acts/activities subject to review by administrative courts
- can generally correctly discuss both basic and more complex legal regulations concerning administrative court proceedings (concerning the subjects of the proceedings, documents, the course of proceedings, decisions, etc.); correctly lists and characterizes the conditions for the admissibility of a complaint to an administrative court
- has a good understanding of the legal regulations regarding ordinary and extraordinary remedies in administrative court proceedings
For a grade of 'very good' (5) student:
- has a well-established and comprehensive knowledge of the nature and organization of administrative courts (can identify the types of administrative courts, the constitutional basis for their operation, statutory acts concerning administrative courts, court bodies, requirements for judicial positions, etc.), as well as assess the model of Polish administrative courts.
- correctly describes the scope of jurisdiction of administrative courts and the subject matter of administrative court proceedings as defined by the regulations, being able to identify specific examples of acts/activities subject to review by administrative courts, linking them to the relevant requirements for the admissibility of a complaint.
- correctly discusses both basic and more complex legal regulations in the field of administrative court proceedings (concerning the subjects of the proceedings, documents, the course of proceedings, decisions, etc.), understanding the relationships between individual institutions; correctly lists and characterizes the conditions for the admissibility of a complaint to an administrative court and connects their absence with the relevant procedural consequences.
- has extensive knowledge of legal regulations regarding ordinary and extraordinary remedies in administrative court proceedings, characterizing the similarities and differences between these remedies and procedures.
