Course objectives and goals: The course aims to present the general issues of general administrative and enforcement proceedings, in order to prepare students for the practical application of administrative law at a basic level. The course aims to provide students with an understanding of procedures specific to public administration and the application of the Code of Administrative Procedure. It also aims to familiarize them with the basics of enforcement proceedings in administration.
Course Content:
1. Branches of Administrative Law and Types of Administrative Procedures
2. Scope of the Code of Administrative Procedure (types of proceedings regulated by the Code of Administrative Procedure, subjective and objective scope of jurisdiction, exclusions)
3. General Principles of Administrative Procedure. Their Legal Nature, Discussion of Individual Principles and Their Guarantees
4. Specific Competence of Public Administration Bodies (Competence and Exclusion, Consequences of Violating These Provisions)
5. Parties to Administrative Proceedings and Entities with the Rights of Parties. Concept and Legal Position
6. Initiation of Administrative Proceedings and Deadlines for Resolving Administrative Cases
7. Technical and Procedural Procedures
8. Explanatory Proceedings, Their Principles and Forms
9. Decisions in Administrative Proceedings
10.Verification of decisions and resolutions during the proceedings. Legal nature of appeals, complaints, and requests for reconsideration. Appellate proceedings. Types of decisions
11. Reopening administrative proceedings. Grounds, procedures, types of decisions, and their effects
12. Declaring a decision (order) invalid. Grounds, procedures, types of decisions, and their effects
13. Annulment and amendment of a decision (Articles 154, 155, and 161 of the Code of Administrative Procedure) and declaration of its expiry (Article 162 of the Code of Administrative Procedure)
14. Basic assumptions of simplified proceedings: regarding the issuance of certificates and the consideration of complaints and motions
15. Basic issues of enforcement proceedings and administrative enforcement. Scope of enforcement, enforcement measures, legal remedies in administrative enforcement

Assessment Criteria:
For a grade of 'very good' (5) student:
- recognizes the need to deepen, update, and organize knowledge of administrative procedure in relation to all topics covered by the course (e.g., by developing issues and presenting results).
- works independently and in groups (often participating in discussions and presenting a critical perspective or presenting their own original ideas and opinions) when solving problems related to the application of administrative procedure provisions.
- recognizes dilemmas related to the interpretation and application of administrative procedure provisions, resolving them using legal regulations and ethical principles.
- is able to classify, analyze, and interpret the statutory premises of institutions and procedural regulations (is able to list all the elements of regulations in a given subject, compare, and evaluate them).
- selects appropriate legal regulations for given problems in the field of administrative procedure, and is able to correctly solve legal problems based on them.
- selects the form of the act of applying the law to given circumstances and is able to prepare an appropriate draft decision or order issued in administrative proceedings. - indicates legal remedies available in administrative proceedings appropriate to the given circumstances, is able to meet the legal requirements imposed on them and formulate allegations of specific violations of the law.
For a grade of "good" (4) - The student:
- recognizes the need to deepen, update, and organize knowledge of administrative procedure. In most of the topics covered by the course (more than half), the student takes steps to achieve this goal (e.g., by developing issues and presenting results).
- works independently and in a group (sometimes participating in discussions) to solve tasks related to the application of administrative procedure regulations.
- recognizes problems related to the application of administrative procedure regulations (e.g., lack of impartiality of administrative staff and judges, speed versus thoroughness of proceedings), attempting to resolve them using legal regulations and ethical principles.
- can classify, analyze, and interpret the statutory premises of institutions and procedural regulations (can list almost all elements of regulations in a given subject and compare them).
- selects appropriate legal regulations for given problems in the field of administrative procedure, and based on these regulations, is able to solve legal problems with individual errors. - selects the form of the act applying the law to the given circumstances, is able to prepare a generally correct draft decision or order issued in administrative proceedings. - identifies the legal remedies available in administrative proceedings appropriate to the given circumstances, and is able to implement the legal requirements imposed on them.
For a grade of "passable" (3) student:
- recognizes the need to deepen, update, and organize knowledge of administrative procedure, but only in relation to some of the topics covered by the course (less than half), and takes steps to achieve this (e.g., by developing issues and presenting results).
- attempts to work independently but does not cooperate in a group (does not participate in discussions) in solving tasks related to the application of administrative procedure regulations.
- recognizes several general problems related to the application of administrative procedure regulations (e.g., lack of impartiality of administrative staff and judges), not always being able to resolve them using legal regulations and ethical principles.
- is able to classify and partially analyze the statutory premises of institutions and procedural regulations (can only provide a few elements of regulations in a given subject).
- selects appropriate legal regulations for given problems in the field of administrative procedure, but is only able to solve individual legal problems based on them.
- selects the form of the act of applying the law to given circumstances, prepares a draft decision or order issued in administrative proceedings, which contains errors. - indicates the legal remedies available in administrative proceedings and their legal basis, appropriate to the given circumstances
For a grade of "fail" (2) student:
- does not recognize the need to deepen, update, and organize their knowledge of administrative procedure and does not take steps to achieve this goal.
- does not work or collaborate in a group to solve tasks related to the application of administrative procedure regulations.
- does not attempt to identify and resolve dilemmas related to the application of administrative procedure regulations and does not connect the acquired knowledge with ethical principles.
- is unable to classify, analyze, and interpret (in accordance with the principles of logical thinking and reasoning) legal regulations concerning administrative procedure.
- is unable to solve specific problems in the field of administrative procedure using appropriate legal regulations.
- is unable to select the form of an act of applying the law to given circumstances and is unable to prepare a draft decision or order issued in administrative proceedings.
- is unable to indicate the appropriate legal remedies available in administrative proceedings and their legal basis for given circumstances.
