Artificial Intelligence in Criminal Proceedings WP-PR-MON-AICP
Course Aim
The aim of the course is to familiarise students with the role, applications, and challenges of artificial intelligence in criminal proceedings. The course develops the ability to identify legal, procedural, and ethical implications of AI technologies used at various stages of criminal justice – from investigation and evidence gathering to adjudication and sentencing. It also aims to improve students’ analytical skills in interpreting procedural norms, assessing the admissibility of AI-generated evidence, and understanding the balance between technological innovation and fundamental rights protection.
Course Description
The course explores how artificial intelligence transforms the theory and practice of criminal procedure. It addresses key issues such as algorithmic decision-making in investigations, evidence authentication, fairness and bias in AI systems, data protection, and emerging regulatory frameworks at national and international levels. Students analyse real and hypothetical cases, review relevant jurisprudence, and discuss ethical dilemmas arising from the use of AI in policing, prosecution, and adjudication. The course combines elements of lecture, guided discussion, and critical analysis of legal and academic sources, aiming to equip students with the ability to evaluate the impact of AI on modern criminal justice systems.

Knowledge:
1. Knows and understands the basic concepts and mechanisms of artificial intelligence relevant to criminal proceedings.
2. Has in-depth knowledge of how AI technologies are applied in different stages of the criminal process – investigation, trial, sentencing, and appeals.
3.Understands the legal, procedural, and evidentiary implications of AI use in criminal justice systems.
4. Knows the main ethical, human rights, and data protection challenges arising from AI-assisted decision-making in criminal procedure.

5. Is able to analyse and critically assess how AI affects fairness, accuracy, and transparency in criminal proceedings.

7. Can apply the principles of criminal procedure to scenarios involving AI tools or automated decision systems.

A series of graded essays assigned after the completed blocks (one essay: from 2 to 3 pages).
