Climate change is a very serious threat and affects many different aspects of our lives. In order to prevent negative phenomena, various measures are being taken to, on the one hand, prepare societies for the changes taking place - those of a long-term nature, such as a steady rise in temperature, rising sea levels, availability of drinking water, changes in ecosystems, and those occurring rapidly, such as torrential downpours, winds and floods, but also droughts, which are of an immediate, destructive nature. On the other hand, action is being taken to reduce greenhouse gas emissions so as to reduce their concentration in the atmosphere, which significantly requires a remodelling of existing energy, agricultural or biodiversity conservation policies.
Many actors are involved in taking action, both public and private.
The subject of this lecture is to provide an overview of the legal regulations aimed at creating regulations on adaptation, i.e. preparation for climate change, and resilience, i.e. the reduction of greenhouse gas emissions.
As climate change is a common problem for humanity, some of this action is being taken at international level. Already in 1992, the United Nations Framework Convention on Climate Change was signed. The next piece of legislation was the Kyoto Protocol and now the legal framework is set by the Paris Agreement.
A distinctive feature of climate change policy is that all states are involved. Consequently, this results in a clash of diverse interests at the annual meetings of the States Parties to the Convention.
Among the participants is the European Union, the only economic organisation representing European member states. In the area of climate change, it plays a dual role. On the one hand, it participates in the international talks, giving them a great deal of momentum, and on the other, it sets an ambitious goal for member states to achieve climate neutrality by the middle of this century.
The presentation of legal regulations at international as well as EU level will familiarise students with the factors shaping these regulations, and will allow them to navigate current issues with ease. It will also equip them with the knowledge to follow future developments in climate law.
