Antidiscrimination law WP-PR-MON-AL
The aim of the course is to familiarise students with anti-discrimination law, with particular emphasis on employment. The following issues will be discussed:
Introduction to discrimination and anti-discrimination law (EK1).
Definition and forms of discrimination (EK1, EK2).
Areas and grounds of protection against discrimination, legal standards of protection and available remedies (EK1, EK2, EK4).
Prohibition of discrimination on grounds of sex (EK1–EK4).
Prohibition of discrimination on grounds of nationality, including EU citizenship, the free movement of workers and relevant CJEU case law (EK1–EK4).
Prohibition of discrimination on grounds of racial or ethnic origin, with particular reference to Directive 2000/43/EC and relevant CJEU case law (EK1–EK4).
Prohibition of discrimination on grounds of religion or belief, disability, age or sexual orientation, with particular reference to Directive 2000/78/EC and relevant CJEU case law (EK1–EK4).
Implementation of EU anti-discrimination directives in the Polish legal system (EK2–EK4).
Prohibition of discrimination under the European Convention on Human Rights and other instruments of international law (EK1–EK4).

Learning outcomes:
EK1: The student correctly uses English legal terminology relating to discrimination and equal treatment (PR_U10).
EK2: The student explains in English the principal concepts and forms of discrimination and identifies the relevant sources of anti-discrimination law (PR_U10).
EK3: The student interprets English-language provisions and case law concerning discrimination and equal treatment (PR_U10).
EK4: The student analyses a specific legal issue concerning discrimination and formulates a reasoned legal assessment in English (PR_U10).
Kryteria oceniania
The achievement of learning outcomes EK1–EK4 will be assessed by means of a final written test. The test will consist of at least 30 questions concerning the issues discussed during classes and the basic literature, including the legal acts and case law indicated in the course materials.
The final test accounts for 100% of the final grade.
The condition for admission to the final test is attendance at classes in accordance with the applicable UKSW regulations. Any absence must be made up in a form agreed with the instructor.
The following grading scale will apply:
5.0 – more than 90% of the available points;
4.5 – more than 80% and up to 90%;
4.0 – more than 70% and up to 80%;
3.5 – more than 60% and up to 70%;
3.0 – more than 50% and up to 60%;
2.0 – 50% or less.
